How the Overtime Calculator Works

Overtime pay in South Africa is governed by the Basic Conditions of Employment Act (BCEA). The Act sets both the minimum overtime rate and a maximum cap on weekly overtime hours. Employees earning above the BCEA earnings threshold (R254 371.67/year) may be excluded from the statutory overtime provisions by agreement with their employer.

The hourly rate is derived from the monthly salary using the BCEA standard working hours assumption: annual salary ÷ (52 weeks × 45 hours per week). This is the same method used in the SCA-tested standard for converting monthly to hourly remuneration in South Africa. Different methods exist but this one is recognised and widely used.

The three overtime scenarios are:

  • Weekday overtime (s.10): At least 1.5× the normal hourly rate for each hour worked beyond ordinary working hours (maximum 45 hours/week).
  • Sunday work (s.16): At least 2× the normal hourly rate for any hours worked on a Sunday, regardless of whether the employee normally works Sundays.
  • Public holiday (s.18): At least 2× the normal hourly rate if worked on a public holiday that falls on a day the employee would normally work.

By agreement, an employer may grant time off in lieu of overtime pay - 90 minutes off for every hour of overtime worked. This must be agreed in writing and taken within 1 month of the overtime worked.

What is the overtime rate in South Africa under the BCEA?

How many overtime hours can my employer require in South Africa?

Can my employer give me time off instead of overtime pay?
Yes, by written agreement. An employer may grant 90 minutes of paid time off for every hour of overtime worked - this is called 'time off in lieu' or TOIL. The time off must be taken within 1 month of the overtime being worked. If it is not taken within 1 month, the employer must pay the overtime at the normal 1.5× rate. This arrangement must be agreed in the employment contract or a separate written agreement.
Does overtime apply to managers and senior employees in South Africa?
The BCEA exempts senior managerial employees and employees earning above the earnings threshold (R254 371.67/year) from the working hours and overtime provisions. However, this exemption is often misapplied - the exemption requires that the employee genuinely manages the employer's business or a division of it and has authority to hire, fire, and discipline subordinates. A title of 'senior' or 'manager' alone is not sufficient to exclude an employee from overtime entitlements.
Is overtime pay taxable in South Africa?
Yes. Overtime pay is ordinary income and is subject to PAYE at your marginal rate in the month it is received. There is no special tax treatment for overtime - it is added to your other remuneration for the month and taxed accordingly. This means months with significant overtime can result in temporarily higher effective tax rates, though your annual liability is reconciled at year-end assessment.
What can I do if my employer refuses to pay overtime?
If your employer refuses to pay overtime that is owed under the BCEA or your employment contract, you have several options: raise a grievance in writing with HR; refer a dispute to the CCMA (Commission for Conciliation, Mediation and Arbitration) - this is free; or lodge a complaint with the Department of Employment and Labour's labour inspectorate. Keep detailed records of all overtime worked, how it was authorised, and what was paid. The employer carries the burden of proving the overtime was not authorised or was paid.
